Has anyone encountered revit allowing a curtain panel to be larger than the "maximum spacing" allows? I have my max. spacing set at 5' and it is allowing panels to be slightly larger (up to 1 49/64" over in some places). We are using max. 5' glass so we can't cut a piece of glass to be larger than that. Is there any way to control the tolerances of the spacing or actually force it to not allow panels larger than 5'?

If you have a preset CW type with the vertical grid pattern switches set to maximum spacing x ... then it will be that. You will have equal spaces - all at or below your maximum spacing.
Do you have the adjust for mullion size switch set? If so, I don't know what affect that will have.

Unfortunately that is not the case. The attached imags show that my max. spacing type constraint is set to 5' and the dimension of the glass when the wall is drawn is over that (@ 5' 0 1/6"). You can see in the family that the glass is offset 1/8" on both sides so that there should be a 1/4" gap between the panes of glass (but the shoes/footings of the panels touch.) Both of these conditions are satisfied when the wall is drawn except that the units themselves are just too large.

You said nothing about a curve. You have to pay attention to the location line of your CW. The spacing is based along that line, not where your glass may be.

The location line is running down the center of the glass--sorry it is not clear in the family image. Does the max spacing constraint just not work on curved runs?

Please verify in your family (curtain panels /system panel / that the glazed curtain panel, type properties is 0".
The way you can test how this spacing works is to change your CW definition to fixed distance rather than max & then see what you have.
